Algemene voorwaarden (English version below)
Deze algemene voorwaarden zijn van toepassing op alle cursussen, workshops en congressen georganiseerd door Handtherapy Skillslab.
1. Algemeen
1.1 Alle cursussen van Handtherapy Skillslab zijn met de grootst mogelijke zorg ontwikkeld en samengesteld.
1.2 Handtherapy Skillslab is niet aansprakelijk voor enige schade die voortvloeit uit het gebruik, de toepassing of interpretatie van adviezen, aanbevelingen of informatie verstrekt in studiemateriaal, lesmateriaal of mondelinge toelichting tijdens de cursus.
1.3 Alle materialen die voorafgaand aan, tijdens of na de cursus worden verstrekt, blijven eigendom van Handtherapy Skillslab. Deze materialen mogen zonder voorafgaande schriftelijke toestemming niet worden vermenigvuldigd, gedeeld met derden of commercieel worden gebruikt.
1.4 Handtherapy Skillslab is niet aansprakelijk voor indirecte schade of gevolgschade, waaronder maar niet beperkt tot inkomensverlies, winstderving of bedrijfsschade.
1.5 Alle informatie op de website van Handtherapy Skillslab is onder voorbehoud van fouten en omissies.
2. Privacy en gegevensbescherming (AVG)
2.1 Handtherapy Skillslab verwerkt persoonsgegevens in overeenstemming met de Algemene Verordening Gegevensbescherming (AVG) en de geldende Nederlandse wet- en regelgeving.
2.2 Persoonsgegevens van deelnemers worden uitsluitend gebruikt voor administratieve en communicatieve doeleinden met betrekking tot de cursus.
2.3 Handtherapy Skillslab behandelt alle door deelnemers verstrekte gegevens vertrouwelijk.
2.4 Persoonsgegevens worden niet met derden gedeeld zonder voorafgaande toestemming van de deelnemer, tenzij dit wettelijk verplicht is of noodzakelijk is voor de uitvoering van de overeenkomst.
3. Cursusvoorwaarden
3.1 Handtherapy Skillslab behoudt zich het recht voor om een cursus tot uiterlijk twee (2) weken vóór de geplande startdatum te annuleren bij onvoldoende deelnemers of in geval van overmacht. In dat geval worden reeds betaalde kosten volledig terugbetaald.
3.2 Handtherapy Skillslab behoudt zich het recht voor om locatie en/of data tot uiterlijk twee (2) weken vóór de startdatum te wijzigen bij onvoorziene omstandigheden. Indien de deelnemer hierdoor niet kan deelnemen, dient dit binnen twee (2) weken na kennisgeving schriftelijk te worden gemeld. In dat geval wordt het volledige cursusbedrag terugbetaald.
3.3 Indien een docent door ziekte of overmacht niet in staat is de cursus te verzorgen, behoudt Handtherapy Skillslab zich het recht voor de cursus te annuleren of te verplaatsen. De deelnemer heeft geen recht op schadevergoeding, maar wel op deelname op een later moment.
3.4 Voor het verkrijgen van een certificaat en eventuele accreditatiepunten is volledige deelname en het afronden van eventuele opdrachten verplicht.
4. Kosten en betaling
4.1 Handtherapy Skillslab is niet CRKBO-geregistreerd en is daarom verplicht BTW in rekening te brengen over haar cursussen.
4.2 Betaling dient te geschieden binnen drie (3) weken na factuurdatum, tenzij schriftelijk anders is overeengekomen.
4.3 Deelname is pas definitief na ontvangst van de volledige betaling door Handtherapy Skillslab.
4.4 In geval van een wachtlijst behoudt Handtherapy Skillslab zich het recht voor een inschrijving te annuleren indien de betaling niet tijdig is voldaan.
4.5 Voor consumenten geldt een wettelijke bedenktijd van veertien (14) dagen conform het Burgerlijk Wetboek. Annulering binnen deze termijn dient schriftelijk te geschieden, waarna reeds betaalde kosten worden terugbetaald.
5. Annuleringsvoorwaarden
5.1 Annulering door de deelnemer dient schriftelijk te gebeuren.
5.2 Bij annulering tot twaalf (12) weken vóór de startdatum wordt €50 administratiekosten in rekening gebracht. Het resterende bedrag wordt terugbetaald.
5.3 Bij annulering binnen twaalf (12) weken vóór de startdatum is de deelnemer 50% van het cursusbedrag verschuldigd. Daarnaast wordt €50 administratiekosten in rekening gebracht.
5.4 Bij annulering binnen twee (2) weken vóór de startdatum is het volledige cursusbedrag verschuldigd en vindt geen restitutie plaats.
5.5 De deelnemer mag een vervanger aandragen tegen €50 administratiekosten. Dit dient uiterlijk twee (2) weken vóór de startdatum schriftelijk te worden doorgegeven en is pas definitief na schriftelijke bevestiging door Handtherapy Skillslab.
5.6 In geval van overmacht of bijzondere persoonlijke omstandigheden kan Handtherapy Skillslab naar eigen inzicht deelname verplaatsen naar een later moment. Dit is geen recht en er bestaat geen restitutieverplichting indien inhalen niet mogelijk is.
6. Toepasselijk recht en geschillen
6.1 Op alle overeenkomsten met Handtherapy Skillslab is uitsluitend Nederlands recht van toepassing.
6.2 Geschillen voortvloeiend uit of verband houdend met deze voorwaarden worden voorgelegd aan de bevoegde rechter in Nederland.
Terms and conditions
These terms and conditions apply to all courses, workshops, and conferences organized by Handtherapy Skillslab.
1. General
1.1 All courses provided by Handtherapy Skillslab are developed and compiled with the utmost care.
1.2 Handtherapy Skillslab shall not be liable for any damage arising from the use, application, or interpretation of any advice, recommendations, or information provided in study materials, course materials, or oral explanations during the course.
1.3 All materials provided before, during, or after the course remain the intellectual property of Handtherapy Skillslab. These materials may not be reproduced, disclosed to third parties, or used for commercial purposes without prior written consent from Handtherapy Skillslab.
1.4 Handtherapy Skillslab shall not be liable for indirect or consequential damages, including but not limited to loss of income, loss of profit, or business interruption.
1.5 All information provided on the website of Handtherapy Skillslab is subject to errors and omissions.
2. Privacy and Data Protection (AVG/GDPR)
2.1 Handtherapy Skillslab processes personal data in accordance with the General Data Protection Regulation (GDPR / AVG) and applicable Dutch data protection laws.
2.2 Personal data provided by participants will only be used for administrative and communication purposes related to the course.
2.3 Handtherapy Skillslab shall treat all personal data and information provided by participants as confidential.
2.4 Personal data will not be shared with third parties without prior consent, unless required by law or necessary for the execution of the agreement.
3. Course Conditions
3.1 Handtherapy Skillslab reserves the right to cancel a course up to two (2) weeks prior to the scheduled start date in case of insufficient participants or force majeure (overmacht). In such cases, participants shall receive a full refund of any fees paid.
3.2 Handtherapy Skillslab reserves the right to change the location and/or dates of a course up to two (2) weeks prior to the start date due to unforeseen circumstances. If a participant is unable to attend due to such changes, the participant must notify Handtherapy Skillslab in writing within two (2) weeks after notification. In such case, a full refund will be issued.
3.3 In the event that an instructor is unable to deliver the course due to illness or force majeure, Handtherapy Skillslab reserves the right to cancel or reschedule the course. Participants shall not be entitled to compensation for damages but shall be offered the opportunity to attend the course at a later date.
3.4 To be eligible for a certificate and any applicable accreditation points, participants must attend the full course and complete all required assignments.
4. Fees and Payment
4.1 Handtherapy Skillslab is not CRKBO-registered and is therefore required to charge VAT (BTW) on all courses.
4.2 Payment must be made within three (3) weeks of the invoice date, unless otherwise agreed in writing.
4.3 Participation is only confirmed once full payment has been received by Handtherapy Skillslab.
4.4 In the event of a waiting list, Handtherapy Skillslab reserves the right to cancel a registration if payment has not been received in a timely manner.
4.5 A statutory cooling-off period (bedenktermijn) of fourteen (14) days applies to consumers, in accordance with Dutch consumer law (Burgerlijk Wetboek). If applicable, cancellation within this period must be made in writing and any fees paid will be refunded.
5. Cancellation Policy
5.1 Cancellation by the participant must be made in writing.
5.2 If a participant cancels up to twelve (12) weeks prior to the start date, an administration fee of €50 will be charged. The remaining amount will be refunded.
5.3 If cancellation occurs within twelve (12) weeks prior to the start date, the participant remains liable for 50% of the course fee. An additional €50 administration fee will be charged.
5.4 If cancellation occurs within two (2) weeks prior to the start date, the full course fee is due and no refund will be issued.
5.5 A participant may designate a substitute participant, subject to a €50 administration fee. This must be communicated in writing at least two (2) weeks prior to the start date and is only valid after written confirmation by Handtherapy Skillslab.
5.6 In cases of force majeure or exceptional personal circumstances, Handtherapy Skillslab may, at its sole discretion, offer the possibility to reschedule participation. This is not guaranteed and no refund obligation applies if rescheduling is not possible.
6. Applicable Law and Jurisdiction
6.1 All agreements with Handtherapy Skillslab shall be governed exclusively by Dutch law.
6.2 Any disputes arising from or in connection with these terms shall be submitted to the competent court in the Netherlands.
